The matter was passed over once. Even on the second call, nobody appears for the Petitioner. Learned Counsel for the Respondent is present along with his wintess, Mr. Deepu Ravi, for recording of evidence.

Due to non-appearance on behalf of  the Petitioner, today, it is not possible to proceed further  in this matter.

Learned Counsel for the Respondent further submits that the Respondent has to incur huge costs as its witness has come all the way from Kerala by cancelling his all other engagements. Hence, a cost must be imposed on the Petitioner for its conduct in the matter despite direction of the Hon'ble Bench in its order dated 11.08.2026.

As requested, let this matter be listed for cross-examination  of witness from both sides witnesses on 21.01.2027.
