ORDER

1.  Case taken up.

2. While hearing arguments, it came to notice that the reliefs prayed are to -

(a) Hold the Disconnection of signals to the Petitioner's network as illegal and arbitrary and direct the Respondent to restore the supply of signal to the network of the Petitioner with immediate effect;

(b) Restrain the Respondent from in any manner interfering/ disrupting, downgrading or disconnecting the signal services being provided to the Petitioner until disposal of this petition;

(c) Direct the Respondent to refund an amount of Rs. 23,40,000/- to the Petitioner towards excess amounts paid by the Petitioner including an amount of Rs. 9,00,000/- towards excess payments made by the Petitioner towards SUN a-la-carte billing;

(d) Direct the Respondent to provide complete Statement of Accounts towards payments made by the Petitioner;

(e) Direct the Respondent to rectify its accounts and Invoices and to raise its Invoices only on the basis of active Set Top Boxes for the Petitioner;

(f) Direct the Respondent to provide the details of its active and inactive Set top boxes to the Petitioner as existing at present;

(g) Direct the Respondent to pay damages to the tune of Rs. 36,00,000/- (Rupees Thirty Six Lakhs only) towards loss of business suffered by the Petitioner due to Petitioner being unable to recover monthly subscriptions due to faulty and outdated CISCO STBs;

(h) Direct the Respondent to pay damages to the tune of Rs. 45,00,000/- (Rupees Forty Five Lakhs only) towards loss of business suffered by the Petitioner due to illegal disconnection of signals to the Petitioner's network and loss of subscription revenue;

(i) Direct the Respondent to pay damages to the tune of Rs. 45,00,000/- (Rupees Forty Five Lakhs only) towards loss of goodwill and reputation suffered by the Petitioner due to illegal and unjustified actions;

(j) pass an ad-interim ex-parte order in terms of prayers (a), (b) and (c) made above; and

(k) pass such other or further orders as this Hon'ble Tribunal deem fit and proper in the facts and circumstances of the present case.

3. Whereas, the order sheet, dated 14.01.2019, has specifically mentioned that "Learned Counsel for Petitioner submits that petitioner will not require any interim relief in this petition because it has already decided to terminate the interconnect agreement with the respondent while the supply of signals stood disconnected ....". Meaning thereby, the Petitioner itself intended and decided not to continue with the interconnect agreement entered, in between.

4. Hence, the relief prayed as above, for future continuation stood infructuous.

5. The past acts and relief prayed with regard to it, remained matter to be adjudged in this proceeding. The same is being fairly admitted by learned counsel for petitioner in its arguments.

6. But this fact is to be brought on record in petition, by way of amendment application, specifying the relief being prayed, and is to adjudged by this Tribunal. When asked for with regard to ambiguity, a time is being requested, for moving appropriate amendment application for making the pleadings up to date and specific.

7. Let amendment application, specifying above situation after serving a copy to other side, be got filed within two weeks. Counter and rejoinder, if any, after exchange in between, may be got filed, within two weeks thereafter.

8. List the matter 'for hearing' on 01.12.2026.
