ORDER

1. Having heard the learned counsels for both sides and looking to the contentious issues raised in this Broadcasting Petition, the same is Admitted.

2. The learned  counsel for the  petitioner has taken me to various provisions  of the  TRAI's the Telecommunication (Broadcasting and Cable) Services Interconnection (Addressable Systems) Regulations,2017  (as amended) issued on 3.3.2017, particularly  regulations 3(2), 3(3), 10(1), 10(14), 14(1) and 18(4) of the Principal Regulation. The learned counsel for the petitioner has strongly argued that they have changed the LCN  as per the agreement because even though the agreement was  signed in March 2026, however in effect, the agreement has been in operation for more than a year.

3. Learned senior counsels appearing for the respondent  have vehemently opposed the arguments advanced by the learned counsel for the petitioner and have cited  various judgements on similar matters passed by this  Hon'ble  Tribunal as well as  the judgment passed by the Hon’ble the Supreme Court of India. In support of their arguments, the learned counsels for the respondent have quoted judgement of the Hon'ble the Supreme Court wherein the Hon'ble the Supreme Court in State of Orissa v. Narain Prasad, (1996) 5 SCC 740 inter alia held that:

"36. Lastly, we may also invoke the holding in  Har Shankar [(1975)1 SCC 737 : AIR 1975 SC 1121] and Jage Ram [(1980) 3 SCC 599 : 1982 SCC (tax) 130 : AIR 1980 SC 2018] that the writ petitioners, having entered into the agreements voluntarily, containing the conditions aforesaid and having done the business under the licence obtained by them, cannot be  allowed to either wriggle out of the agreements nor can they be allowed to challenge the validity of the Rules which constitute the terms of the contract..." .

4. Having heard the learned counsels for  both the parties and looking at the facts and circumstances of the matter, interim relief as sought by the petitioner against the disconnection notice of the respondent is not  granted at this point of time.

5. Notice upon the respondent, which is accepted by learned counsel Mr. Ranjeet Singh Sidhu, who seeks time to file Vakalatnama and reply. Vakalatnama and reply be filed on or before 24.10.2026.

6. List the matter under the heading “For Directions”  on 27.10.2026.
