ORDER

1. We have heard learned counsel appearing for Decree Holder (original petitioner) who has submitted that despite the judgment and decree passed by this Tribunal in BP 487/2014 on 10.12.2025 and despite the decretal amount  which is at Rs.89,34,542/- as on 31.03.2026, nothing has been paid by Judgment Debtor.

2. Learned counsel appearing for the Judgment Debtor (original respondent) submitted that neither they have preferred any appeal against the judgement and decree passed by this Tribunal in BP 487/2024, nor they have filed and reply in this Execution Application and nor they have any intention to pay the decretal amount.

3. We, therefore, issue  Non-Bailable Warrant upon the Director of the Judgement Debtor whose details are as under:

Mr. Devender Kumar Srivastava, S/o Mr. Bageshwari Lal Srivastava, R/o B-1/75, Sector-G, Aliganj, Lucknow, Uttar Pradesh-226024, Director, Sahara India Commercial Corporation Ltd.

4. The SHO concerned of the aforesaid Police station shall arrest  the aforesaid Director of the Judgement Debtor and he will be produced before this Tribunal immediately. This Non-Bailable Warrant shall be executed upon the aforesaid Director Mr. Devender Kumar Srivastava  with effect from 06.11.2026.

5. We are giving time to the Judgement Debtor to make the payment of decretal amount on or before 05.11.2026, failing which the Non-Bailable Warrant shall be executed by the SHO of the aforesaid Police Station. The arrested person shall be produced before this Tribunal immediately.

6. Judgement Debtor is permitted to file an application for modification of today's order in case of any difficulty.

7. Hence, the matter is adjourned on 11.01.2027.
