2. File has been received from Court No. 1. Today is the first date. None is for respondent.  Petitioner is present. Though there is mention of completion of pleadings, but apparently the examination in chief filed by the affidavit by both side has not been cross-examined by either side.

3. Hence, the oath against oath is there. The same is in the form of reiteration of contention of petition as well as reiteration of contention of reply. Then what is the correct position and how the evidence is to be appreciated unless the witnesses are not being tested on the anvil of cross-examination.
